Standard Payment Terms: Unless and until you are accepted as an Approved Credit Customer of American Eyewear, LLC you are required to pay for products at the time of ordering.

 

 

Credit Policy:  You may apply to establish credit account with American Eyewear, LLC by submitting a Credit Application to Customer Service.  If, in American Eyewear’s sole discretion, you meet its credit standards, you will be designated an Approved Credit Customer. As an Approved Credit Customer, you are required to pay for products ordered within thirty (30) days from the date of the invoice for the order.  A late charge will be applied at the rate of 1-1/2% per month on all past due account balances.  A past due balance may result in the discontinuance of any discounts.

 

 

Discounts: You agree that your eligibility for any discount offered by American Eyewear is contingent upon you purchasing at least forty (40) frames net during the calendar year in which you received the discount.  American Eyewear reserves all rights to charge you the full price on products you previously purchased at a discount and on all future products purchased if you fail to meet the above stated purchasing requirement.

 

 

Product Price & Sales Tax:  All products are subject to price change without notice.  Orders are accepted subject to prices in effect at the time of shipment.  All products sold by American Eyewear are sold at wholesale and, therefore, exempt from sales tax.  American Eyewear disclaims all requirements and responsibility to collect and pay sales tax.

 

 

Warranty Policy:  American Eyewear offers a one (1) year manufacture's warranty to you on its products that are imported  from the date of the invoice of your order.  This warranty may be transferred to retail stores who purchase American Eyewear products directly from you and to customers purchasing American Eyewear products from such retail stores.  Warranted manufacturer’s defects include the breaking of solder or weld points, faulty spring hinges, and color finish discoloration, but do not include defects caused by, or associated with, normal wear and tear, exposure to flying particles, street wear, or abuse or improper handling.  Customers are responsible for all daily maintenance of the product.  THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

 

This warranty covers only American Eyewear products purchased directly from American Eyewear, from an authorized Sales Representative, or from a retail store which purchased the product directly from American Eyewear or an authorized Sales Representative.  You must submit proof of purchase to American Eyewear in the form of an invoice or charge slip when presenting a product for replacement.  Any product presented without proof of purchase will be excluded from this warranty.

 

American Eyewear shall not be liable for personal injury, incidental, special, punitive, exemplary, consequential, or other damages resulting from the use of its products by you or other in the chain of distribution, or arising out of any breach of this warranty, negligence, or any other cause of action, or for delay in delivery, or for misuse or abuse of its products by you or others in the chain of distribution.  This warranty gives you specific legal rights and you may also have other rights which vary from state to state.  If a problem with this product develops during or after the warranty period, you may contact Customer Service at 615-891-2558.

 

 

General Return and Exchange Policy:  American Eyewear conducts business exclusively with its authorized Sales Representative and retail stores on all returns for exchange or credit.  American Eyewear does not accept returns or exchanges from customers.  Therefore, all consumer inquiries regarding product return for exchange or credit for any reason shall be referred back to the retail store where they purchased the product or their authorized Sale Representative to return the product for exchange or credit.  All returns for exchange or credit are subject to the following additional requirements and limitations:

 

 

Shipping:  You are responsible for all shipping charges, expenses, and insurance associated with products you return for exchange or credit.  American Eyewear will not accept C.O.D. returns, so please pre-pay your shipping charges.  Take care that the products are wrapped and protected during return shipment, as you are responsible for any damage to the expenses, and insurance associated with American Eyewear’s shipment of replacement or exchange products.

 

 

Closeouts/Sales:  Special value and closeout products purchased at reduced prices are final sale merchandise and are not returnable for exchange or credit.

 

 

Proof of Delivery: Please note that Proof of Delivery alone does not substantiate the number of products received.  In the case of shortages or overages, American Eyewear will issue credit only for items actually received.

 

 

Discontinued Items: In the event of discontinuation of an entire brand, product from discontinued brands will be accepted for exchange for a period of no longer than one (1) year from date of discontinuation of the brand.  Warranty exchanges on discontinued brand products will be honored according to the original terms of the sale.

 

 

Prescription Lens:  Prescription lenses included with returned product will be discarded.

 

 

Product Condition: Your must return the product in its original, condition, free of any modification such as personal markings, disassembly, or adjustments.  The product must also be returned with the original demonstration lenses and case, any and all display and marketing materials (if provided at sale).  Products returned as defective which American Eyewear, LLC determines to have been damaged due to normal wear and tear, exposure to flying particles, street wear, or abuse or improper handling will not be accepted for return for exchange or credit.

 

Only products eligible for return or exchange or credit and purchased directly from American Eyewear or an authorized Sales Representative can be returned for credit or exchanged.  American Eyewear reserves the right to review and disallow returns for exchange or credit in accordance with its terms and conditions.

 

 

Warranty Products:  If you want to return a warranted product because the product is defective you must return the defective product to American Eyewear office at 3744 Annex Avenue, Suite B2, Nashville, TN 37209 marked “Warranty Frame” on the outside of the package, with a copy of the original invoice, a description of the defect and your contact information.  If American Eyewear decides, in its sole discretion, that the product is under warranty, American Eyewear will send you a replacement product and charge your account for any shipping cost incurred.  If the product has bee discontinued and American Eyewear cannot provide you with a new product, American Eyewear will credit to your account for the purchase price of the product.  Credits to your account may only be used for future product purchases.  Credits will not apply to past due balances on your account.

 

If American Eyewear determines a returned product or part is not defective due to normal wear and tear, exposure to flying particles, street wear or abuse or improper handling o of the product American Eyewear will return the product or part with a letter of explanation and charge your account for any shipping charges incurred.  American Eyewear does not make warranty decisions over the phone.

 

 

Customer Approved Products:  If you ordered products for customer approval and want to return the product(s) that the customer did not want to purchase, you must return the product(s) to American Eyewear office at 3744 Annex Avenue, Suite B2, Nashville, TN 37209 marked “Patient Approval Return”  on the outside of the package, with a copy of the invoice stating that this was a customer approval product(s), a written statement from the authorized Sales Representative approving the return, and your contact information.  American Eyewear will credit your account for the returned product.  Credits to your account may only be used for future product purchases.  Credits will not apply to past due balances on your account.

 

 

Returns/Exchanges: All returns/exchanges must have an RA number (return authorization) on the outside of the box.  All returns must be within thirty (30) days of original shipment for full credit to be received.  After thirty (30) days product is only applicable for an exchange and the rules and regulations that apply to that program.

 

Exchanges may be made for replacement product only, not for cash or other credit.  In order to exchange a product, you must reorder at least two new products from your Sales Representative for each product returned.  If you want to exchange a product, you must return the product to American Eyewear’s office at 3744 Annex Ave, Suite B2, Nashville, TN 37209 marked, “Return” on the outside of the package, with a copy of the original invoice, a return authorization form signed and dated by the Authorized Sales Representative, a copy of the reorder from the authorized Sales Representative, and your contact information.  You may not return more than ten products at a time.  American eyewear will ship you the newly ordered product and charge your account for any shipping charges incurred.

 

 

Shortages, Overages, or Wrong Product Shipped:  If you want to return any item because there was overage in your shipment or the wrong product was sent, you must send the product to American Eyewear’s office at 3744 Annex Avenue, Suit B2, Nashville, TN 37209 marked “Return” on the outside of the package, with a written request to us explaining overage or error and requesting either a return for credit or exchange of the product, a copy of the original invoice, and your contact information.  If the wrong product was sent, American Eyewear will send yo the correct product.  If you were sent an overage, American Eyewear will credit your account for the returned product.  If you were shorted a product, please send a copy of the original invoice to the address above, along with a written request for American Eyewear will send you the correct product.  If you were sent an overage, American Eyewear ill credit your account for the returned product.  If you were shored a product, please send a copy of the original invoice to the  address above, along with a written request for American Eyewear to correct the shortage by shipping the additional product(s) to you.

 

 

Resale Terms and Conditions:  You agree that all products purchased from American Eyewear are exclusively for in-office or in-store resale to retail customer s and are not for distribution at wholesale or for resale in any other manner.  Internet sales are prohibited.

 

 

Shipping Policies:  In the absence of specific shipping instruction, American Eyewear  will determine the most reasonable manner to ship the product.  All of American Eyewear’s products are shipped via USPS, which, in most cases, will get your package to you in approximately five (5) business days.  Upon request, American Eyewear can also ship your package via Express Mail.. American Eyewear is not responsible for any freight delay due to third party shipping delays.
